Welcome to P.art Promise! The terms “we”, “us” and “our” refer to P.art Promise. P.art Promise operates this store and website, including all related information, content, features, tools, products, and services to provide you, the customer, with a curated shopping experience focused on creating custom epoxy resin art from flowers and other personal keepsakes you provide (the “Services”). P.art Promise is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use our Services. You are responsible for maintaining the confidentiality of your account credentials and all activities under your account. Accounts may not be transferred, sold, or assigned to others.

SECTION 2 - OUR PRODUCTS AND CUSTOM ART SERVICES

P.art Promise specializes in creating unique epoxy resin art using natural items you send us, such as flowers and other keepsakes. We carefully preserve and incorporate these items into custom pieces of art.

Please note:

  • Colors and appearance of final products may differ from images due to the natural variations in the items you provide and the epoxy resin process.

  • Each piece is unique because of the organic materials used; exact replication is not possible.

  • We do not guarantee that the final artwork will match your expectations perfectly but strive for high quality and craftsmanship.

  • By submitting items to us, you acknowledge that some natural degradation, discoloration, or fragility may occur during preservation.

  • All product descriptions and services are subject to change without notice.

SECTION 3 - ORDERS AND SUBMISSIONS

By placing an order for custom artwork, you make an offer to purchase the Services. We reserve the right to accept or reject your order at our discretion. Your order is confirmed only after we notify you of acceptance.

Because custom artwork depends on the personal items you submit:

  • You are responsible for securely sending us your flowers or keepsakes. We are not liable for loss or damage during shipping.

  • Please package your items carefully to prevent damage.

  • We will notify you upon receipt and confirmation of your items.

  • Custom artwork creation begins only after item confirmation and payment processing.

  • Cancellations after acceptance may not be possible due to the personalized nature of the Service.

SECTION 4 - PRICES AND PAYMENT

Prices for custom artwork reflect the time, materials, and craftsmanship involved and are subject to change without notice. The price in your order confirmation is final.

Prices do not include shipping, taxes, or customs charges unless specified. You agree to provide accurate and complete payment information and to pay all amounts due in a timely manner.

SECTION 5 - SHIPPING AND DELIVERY

We carefully package and ship completed artwork. Shipping times are estimates and not guaranteed. We are not responsible for delays caused by carriers or customs. Once shipped, title and risk pass to you.

SECTION 6 - INTELLECTUAL PROPERTY

All content, trademarks, and artwork designs created by P.art Promise are owned by us or our licensors. By using our Services, you agree not to copy or reproduce any content without permission.

You grant P.art Promise a license to use any feedback, images, or content you provide related to custom artwork for promotional or operational purposes.

SECTION 7 - CUSTOMER-SUBMITTED ITEMS

You acknowledge and agree:

  • You retain ownership of items sent, but grant P.art Promise the right to permanently incorporate them into your custom artwork.

  • We are not liable for any sentimental or monetary loss of items sent to us once received.

  • You are responsible for ensuring that items sent do not violate any laws or third-party rights.

  • We recommend keeping digital copies or photographs of items sent as we cannot return or replace submitted keepsakes.

SECTION 8 - DISCLAIMERS AND LIMITATIONS

Due to the nature of custom art and organic materials:

  • We disclaim warranties that the final artwork will meet all expectations or be free from imperfections.

  • We are not liable for damage, loss, or dissatisfaction resulting from the epoxy process or shipping.

  • Our liability is limited to the amount paid for the custom artwork.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

P.art Promise is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with P.art Promise. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and P.art Promise, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with P.art Promise.
